More about process serving
01

Documents and instructions

Enquire about civil, Small Claims Court, family or other document-service requests. The document, court or tribunal, parties and any order determine the requirements. Acceptance is confirmed after review.

02

Service attempts and updates

Discuss the service address, deadline, permitted method, number of attempts and reporting arrangements. Alternative or substituted service must have the appropriate authority; it is not chosen merely for convenience.

03

Proof of service

A completion record is discussed for every assignment. Where an affidavit is required, the relevant form and commissioning arrangements must match the proceeding. A record of an unsuccessful attempt does not claim successful service.

04

Scope, fees and confidentiality

Agree on document handling, attempts, travel, printing, proof documentation, commissioning and any additional charges before work starts. Confidential files are shared through an agreed follow-up channel.

This service covers document delivery, not legal advice, representation or enforcement. Court filing is separate. Timing and successful delivery cannot be guaranteed.

GOOD TO KNOW

Process Serving FAQs

What is process serving?

It is delivery of legal documents using the method required for the particular proceeding. Requirements vary, so instructions and suitability are reviewed before an assignment is accepted.

Which details should I provide first?

Share your contact information, general document type, service city and requested date. Recipient addresses, case documents and sensitive information belong in a private follow-up.

What if the recipient cannot be served?

The agreed attempts and results are reported. Further attempts or another permitted method require discussion; a court order may be needed for substituted service.

Is an affidavit of service included?

We agree what proof you need and how any sworn statement will be arranged. The form depends on the court. Small Claims Court commonly uses Form 8A, civil court Form 16B and family court Form 6B.

Can I get legal advice or guaranteed court acceptance?

No. Process serving is not legal advice or a guarantee that a court will accept a document. Ask a licensed legal professional about your legal obligations or strategy.
